Terms of Service

1. Agreement to Terms

By accessing, deploying, or utilizing the Pin Engine application ("the Service"), you agree to be bound unconditionally by these Terms of Service. If you do not agree, you MUST terminate usage immediately.

2. Intellectual Property, Asset Ownership & DMCA Compliance

You retain sole ownership of all photographs, illustrations, and multimedia assets uploaded through the Service. By staging assets for RSS syndication or CSV compilation, you represent and warrant that:

• You own or possess all requisite rights, licenses, consents, and permissions to syndicate the media content.
• Content uploaded does not infringe any copyright, trademark, patent, trade secret, or privacy right under the Copyright Act (Cap 130, Laws of Kenya), the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512), or international treaties.
• You grant this system a transient, non-exclusive license strictly to process, re-encode, store, and expose media enclosures to Pinterest crawlers and client user agents.

3. Compliance with Kenya Computer Misuse and Cybercrimes Act (No. 5 of 2018)

You explicitly warrant that your usage of this platform SHALL NOT violate the Computer Misuse and Cybercrimes Act, 2018 (Laws of Kenya). You MUST NOT:

• Attempt unauthorized access to underlying system directories (Sections 14 & 15).
• Upload ZIP archives designed to execute path traversal attacks (Zip Slip) or malicious scripts (Section 16).
• Initiate Distributed Denial of Service (DDoS) loops or XML entity expansion exploits (Section 18).
• Syndicate obscene, fraudulent, cyber-harassment, or hate speech material (Sections 27 & 28).

4. Pinterest Platform & Bulk Publishing Terms

This application automates syndication via Pinterest's standard RSS 2.0 Auto-Publish and Bulk CSV ingestion tools. Users are strictly bound by the Pinterest Terms of Service and Community Guidelines:

• All destination links (<link>) MUST route to verified, claimed domains registered to your Pinterest Business profile.
• Automated feeds MUST NOT be used for link cloaking, affiliate spam distribution, or deceptive redirects.
• Daily publication volume MUST respect Pinterest's safe ingestion ceiling (up to 200 pins per 24-hour cycle) to prevent automated anti-bot throttling.

5. Disclaimer of Warranties & Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. Under no circumstances SHALL the platform operators be liable for account suspension, rate-limiting, algorithmic down-ranking by Pinterest, or data loss arising from automated syndication.

6. Governing Law & Dispute Resolution

These Terms SHALL be governed and construed in accordance with the Laws of the Republic of Kenya. Any dispute arising under these Terms SHALL be submitted to the exclusive jurisdiction of the competent courts sitting in Nairobi, Kenya.
